1. Who's behind this

Playfultech, Lda ("Playfultech", "we", "us") is a company registered in Portugal. We operate Pierre Le Duck — a mobile app and website at pierreleduck.app that helps you estimate the resale value of items you photograph, draft listings, and share them publicly if you choose (collectively, the "Service").

2. What Pierre is, and what Pierre isn't

Pierre is an AI-powered appraisal tool. You photograph an item; Pierre estimates a resale price, suggests a listing, and recommends platforms to sell on. That's the entire job.

Pierre is not a marketplace. We do not buy, sell, hold, ship, escrow, or otherwise touch the items you list. Transactions happen on third-party platforms (Vinted, Depop, eBay, Wallapop, StockX, and similar), governed by their own terms. Their rules, their disputes, their fees.

Valuations are estimates, not guarantees. Pierre is opinionated, but markets are not. The actual price you achieve depends on demand, your listing, condition, timing, and luck. Do not rely on a valuation as financial advice, an appraisal for insurance or tax purposes, or a guarantee of sale.

3. Your account

You need an account to use most of the Service. To create one you must:

• Be at least 16 years old. If your country has a higher digital age of consent, that applies.
• Provide accurate information and keep it up to date.
• Keep your login credentials confidential — anything done under your account is your responsibility.

You may close your account at any time from the app or by emailing us. We may suspend or terminate accounts that violate these terms — more on that in Section 11.

4. Acceptable use

Pierre exists to help honest sellers. Don't ruin that. You agree not to:

• Upload photos or content you don't own or have rights to use.
• Scan or list items that are illegal to sell in your jurisdiction — counterfeit goods, stolen property, regulated items (firearms, controlled substances, live animals, human remains, and similar), or anything that violates third-party rights.
• Use the Service to harass, defame, defraud, or impersonate anyone.
• Upload content that is hateful, sexual, threatening, or otherwise unlawful.
• Attempt to reverse-engineer, scrape, copy, or interfere with the Service or its underlying models.
• Use bots, automation, or scripts to interact with the Service without our written permission.
• Try to manipulate Pierre's valuations through fake photos, misleading metadata, or any kind of input gaming.

We may remove content or restrict accounts that break these rules. We may also report unlawful activity to the relevant authorities.

5. Your content

"Your Content" means everything you upload or create through the Service — photos, item details, listings, storefronts, profile information, and so on.

You keep ownership of Your Content. By uploading it, you grant Playfultech a worldwide, non-exclusive, royalty-free licence to host, process, display, reproduce, and adapt it solely to operate, improve, and promote the Service. For publicly shared content (such as storefronts and share cards), this licence extends to displaying that content to anyone with the link.

You are responsible for Your Content. You represent that you have the right to upload it and that it does not violate anyone's rights or any law.

AI training: we do not allow third-party AI providers to train their models on Your Content. We may use Your Content to improve our own valuation models, including reviewing scans, valuations, and outcomes to make Pierre more accurate. We apply technical and organisational measures to protect your data when we do this, and we de-identify content wherever possible. Full details in our Privacy Policy.

6. Public storefronts and shared listings

If you publish a storefront or share a listing card, the content you make public becomes visible to anyone with the link. You control what's published and can unpublish or delete it at any time. We are not responsible for how others use content you have chosen to make public.

7. Third-party platforms

Pierre recommends platforms to list on and may link out to them, but we have no control over those platforms, their pricing, their fees, their policies, or their users. Anything you do on Vinted, Depop, eBay, Wallapop, StockX, or any other third party is between you and them. We are not a party to your transactions and not responsible for outcomes.

8. Fees and subscriptions

Pierre Le Duck is free to download. The free tier includes 3 item scans per calendar month, after which scans are paused until the next month or until you subscribe.

Subscription. A paid subscription unlocks unlimited scans and any other premium features we add. Pricing, billing period, and your country's applicable taxes are shown in the app before you confirm a purchase.

Billing. Subscriptions are billed through the Apple App Store or Google Play, depending on where you downloaded the app. Payment is charged at confirmation of purchase and at the start of each renewal period.

Auto-renewal. Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. You can manage or cancel at any time in your Apple ID or Google Play account settings — not from inside Pierre.

Refunds. Refund requests for subscriptions are handled by Apple or Google under their respective policies. We don't process refunds directly because we never see your payment.

Free tier counter. The 3 free scans reset on the first day of each calendar month, regardless of when you signed up. Unused scans do not carry over.

Changes to pricing or limits. If we change the free tier limit, subscription price, or what's included, we will notify you in-app or by email at least 30 days before the change takes effect for you. Your existing free-tier access at the time of signup will not be retroactively reduced without that notice.

EU consumers: under the Consumer Rights Directive, you normally have a 14-day right to withdraw from digital purchases. By starting your subscription and accessing premium features immediately, you expressly consent to the supply of the digital service before the withdrawal period ends and acknowledge that you lose the right to withdraw once supply has begun. This is required by Apple and Google, who handle the transaction.

9. Intellectual property

The Service, including the Pierre Le Duck name, the duck mascot, the brand, the app's design, code, models, copy, and all related materials, is owned by Playfultech, Lda and protected by intellectual property laws. These terms do not give you any rights to use our trademarks, brand assets, or copyrighted material outside of normal use of the Service.

10. Beta features

Pierre is in active development. Some features may be labelled "beta", "preview", or "early access". They may break, change, or disappear. Use them with that in mind. Feedback is welcome and appreciated.

11. Suspension and termination

We may suspend or terminate your account, with or without notice, if you break these terms, if required by law, or if continuing to provide the Service to you creates a serious risk to us or other users. We will give reasonable notice where possible.

You may stop using the Service at any time and delete your account from the app or by emailing us. After deletion, your personal data is handled according to our Privacy Policy.

12. Disclaimers

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we make no warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy of valuations, uninterrupted availability, or non-infringement.

Pierre's valuations are informational only. We do not guarantee that any item will sell, sell at the estimated price, or sell within any particular timeframe.

Nothing in these terms excludes or limits liability that cannot be excluded under applicable law, including your statutory rights as a consumer.

13. Limitation of liability

To the maximum extent permitted by law, Playfultech, Lda will not be liable for:

• Indirect, incidental, consequential, special, or punitive damages.
• Loss of profits, revenue, data, goodwill, or business opportunities.
• Decisions you make based on Pierre's valuations or recommendations.
• The acts, omissions, content, or policies of third-party platforms or other users.

Our total aggregate liability to you for any claim arising out of or relating to the Service is limited to the greater of: (a) the amount you have paid us in the 12 months preceding the claim, or (b) EUR 50.

If you are a consumer in the EU, this section does not limit any rights you have that cannot be waived under mandatory consumer protection law.

14. Indemnity

You agree to indemnify and hold Playfultech, Lda harmless from claims, damages, and reasonable costs (including legal fees) arising from Your Content, your breach of these terms, or your misuse of the Service. This does not apply to the extent the claim results from our own breach or negligence.

15. Changes to the Service or these terms

We may update the Service and these terms from time to time. If we make material changes to the terms, we will notify you through the app or by email at least 30 days before they take effect. Your continued use of the Service after the effective date means you accept the updated terms. If you don't, you can close your account.

16. Governing law and disputes

These terms are governed by the laws of Portugal, without regard to conflict-of-laws principles. Disputes will be brought before the competent courts of Porto, Portugal, except where mandatory law (such as EU consumer law) gives you the right to bring proceedings in your country of residence.

EU consumers may also use the European Commission's Online Dispute Resolution platform: ec.europa.eu/consumers/odr.

17. Miscellaneous

Entire agreement: these terms, together with the Privacy Policy and any feature-specific terms we publish, are the entire agreement between you and us regarding the Service.

Severability: if any provision is found unenforceable, the rest stays in force.

No waiver: if we don't enforce a right, that's not a waiver of that right.

Assignment: you may not assign these terms without our consent. We may assign them to an affiliate or successor as part of a corporate reorganisation or sale.

Force majeure: we are not liable for failures caused by events outside our reasonable control.

18. Apple App Store additional terms

If you downloaded Pierre Le Duck from the Apple App Store, the following also applies:

• These terms are between you and Playfultech, Lda only — not Apple. Apple is not responsible for the Service or its content.
• Your licence to use the app is limited to use on Apple-branded devices you own or control, as permitted by the App Store Terms of Service.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to conform to any applicable warranty, you may notify Apple, who will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation.
• Claims relating to the app (product liability, legal compliance, consumer protection) are our responsibility, not Apple's.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

19. Google Play additional terms

If you downloaded Pierre Le Duck from Google Play, your use is also subject to the Google Play Terms of Service. In the event of a conflict between these terms and the Google Play Terms of Service relating to your use of the app obtained through Google Play, these terms apply only to the extent permitted by the Google Play Terms of Service.
